OFFER AGREEMENT

The online store "Effectplants.com.ua", hereinafter referred to as the "Seller", offers any individual or legal entity, hereinafter referred to as the "Buyer", to place an order and purchase products, the images of which are posted on the website "https://effectplants .com.ua".

The site is a publicly accessible website https://effectplants.com.ua, open for free visual inspection, owned (or legally used) by Albert Oleg and through which the goods are provided and sold.

By placing an order on the Site, the Buyer voluntarily confirms acceptance of the following provisions:

1 GENERAL PROVISIONS

1.1. Terms and definitions

In these rules for buying and selling goods in the "Effectplants.com.ua" online store, the terms are used in the following sense:

The buyer is a natural person who has reached the age of 18 and has full civil legal capacity, who places the Order and purchases, orders, uses or intends to purchase or order the goods presented on https://effectplants.com.ua, for personal needs, directly not related to entrepreneurial activity or the performance of the duties of an employee.
The seller is a natural person-entrepreneur Albert Oleh Borisovych, taxpayer registration card number 2754712571, with registered address: Ukraine, 61168, Kharkiv region, Kharkiv city, Kyiv district, str. Valentinivska.

Internet store "Effectplants.com.ua" is a tool for presenting and/or selling goods, work or services by performing electronic transactions on the Site.

Personal Cabinet - a personalized interface of the Site with a set of tools designed for the user to make purchases from the catalog of the Internet store "Effectplants.com.ua" on the Site.
A product is a material object offered for sale on the Site.
The product card is a set of information about the product, which includes the name of the product, image of the product on the website, its description, price, characteristics, color, size, configuration, availability in the store, etc.
Order - the Buyer's request addressed to the Seller, properly executed and placed on the Site, for the purchase and delivery of the Goods selected on the Site to the address specified by the Buyer.
The cost of the Order is the amount to be paid when the Buyer receives the order, after applying discounts or bonuses, taking into account the cost of delivery. Taxes provided for by current legislation are included in the calculation of the value of the Order.
The price of the Goods is the monetary expression of the price of the goods, specified in hryvnias without taking into account the cost of delivery of the Order. The cost of the product is indicated in the delivery note, which is provided to the Buyer together with the product.
The contract is a public electronic contract for the purchase and sale of Goods concluded by the Seller with the Buyer at a distance using means of remote communication (Internet) under the conditions set forth in these Rules. The minimum duration of the Agreement is determined by the term of execution of the Buyer's Order, issued taking into account the conditions of these Rules.
Courier company is the relevant courier company that provides services for the delivery of the Order, and which the Buyer chooses from those offered on the Site when placing the Order.
Personal data - personal information (including surname, first name, patronymic, date of birth, address, contact phone number, e-mail address, registration number of the taxpayer's registration card (TIN) and current account number in the bank (provided only when registering return of the Goods)), voluntarily and knowingly provided by the User when registering and/or placing an Order on the Site, and is necessary for the fulfillment of the order by the Internet store "Effectplants.com.ua".

1.2. This contract is a public offer and does not require signature (in accordance with Articles 633, 641 and Chapter 63 of the Civil Code of Ukraine). The public offer agreement has the same legal force as a contract signed on paper. This contract contains all the essential conditions for the organization of the purchase and sale remotely, that is, with the help of the Internet, which excludes the possibility of direct acquaintance of the Buyer with the Goods

1.3. In case of acceptance of the terms of this contract (that is, the public offer of the online store), the citizen (or legal entity) accepting the offer becomes the Buyer. Acceptance is the fact of payment of the order in the amount of 100% under the terms of this agreement.

1.4. The seller carries out retail sales of goods through the online store http://effectplants.com.ua

1.5. Within the framework of this Agreement, the design (image of the product corresponding to a specific article) of the product item is recognized as a product sample.

1.6. The Seller reserves the right to amend this Agreement without prior notice to the Buyer.

2. RIGHTS AND OBLIGATIONS OF THE BUYER

2.1. To place an order, the Buyer undergoes automatic registration on the Site.

2.2. The Buyer orders goods from the catalog on the Site and sends it to the Seller.

2.3. If the Buyer has any questions regarding the properties and characteristics of the goods, the Buyer may contact the Seller in any available way before placing the order.

2.4. The buyer undertakes to correctly indicate his surname, first name, contact phone number, including city code, exact and complete delivery address in the order, as well as to agree with the seller on the desired day and time of delivery.

2.5. The Buyer undertakes to meet the Seller's courier at a certain time at the specified delivery address.

2.6. The buyer has the right to refuse the delivered goods. In case of refusal, the Buyer pays the Seller's transport costs in full, incurred by him for the delivery of the goods to the Buyer's city, the return of the goods to the Seller's city at the rates of the courier service.

2.7. The buyer pays for the order using any convenient method selected in the online store.

3. RIGHTS AND OBLIGATIONS OF THE SELLER

3.1. The Seller informs the Buyer about the acceptance of the order by phone and/or e-mail, agrees on additional characteristics, product configurations and their cost.

3.2. The Seller undertakes to deliver the goods in accordance with the received order, in the quantity, prices and terms agreed with the Buyer.

3.3. The seller guarantees the conformity of the appearance of the goods with their samples in the catalog. The characteristics and appearance of the product declared on the Site may differ slightly from the sample.

3.4. The Seller is not responsible for the accuracy and correctness of the information provided by the Buyer during registration.

4. DELIVERY

4.1. Delivery of goods is carried out throughout the territory of Ukraine.

4.2. The Seller will make every effort to comply with the delivery terms agreed with the Buyer. However, delays in delivery due to possible unforeseen circumstances that are not the fault of the Seller.

4.3. The cost of order delivery is indicated on the Seller's website in the "Payment and Delivery" section and may vary depending on the type of delivery.

4.4. When receiving an order by mail or from a courier, the Buyer must check the package. If, after disclosure, a shortage, replacement, or damage to the goods is found, the Buyer must draw up an Act and notify the Seller of the problem in any available way. Otherwise, the Seller is not responsible for possible damage or theft of the parcel.

5. COST OF GOODS

5.1. The exact price of the goods is specified in the catalog on the Site.

5.2. The price of the goods on the Site can be changed unilaterally by the Seller.

6. RETURN OF GOODS AND WARRANTY SERVICE

6.1. The buyer can return (exchange) the goods only if they turned out to be of inadequate quality, including, but not exclusively, if their appearance does not meet the requirements, expiration dates are violated, and there are organoleptic comments (for which an expert opinion is required).

6.2. The exchange of goods of appropriate quality is carried out if it has not been used and if its appearance, consumer properties, seals, labels have been preserved, as well as in the presence of a document confirming the purchase of this product from the Seller.

6.3. Products of appropriate quality, the list of which is approved by the Resolution of the Central Committee of Ukraine No. 172 dated 03/19/94, are not subject to exchange (return).

6.4. If a defect is discovered, the Buyer undertakes to inform the Seller about it within 2 days from the moment of delivery of the order. To confirm the defect, the product is sent to the Seller for examination. In the positive case, the Buyer will be reimbursed the full value of the goods.

7. Other conditions

7.1. The Buyer gives permission for the Seller to process his personal data for the purpose of fulfilling the terms of this Agreement, the possibility of making mutual settlements, as well as for receiving invoices, acts and other documents.

7.2. All information provided by the Buyer to the Seller may not be transferred for review and / or use to third parties, except for the written permission of the Buyer to transfer this information and cases when it is required by Ukrainian or international legislation and / or authorities in compliance with the legal procedure.

7.3. The law of Ukraine applies to the relations between the Buyer and the Seller.

7.4. In case of questions and claims on the part of the Buyer, he should contact the Seller in any available way. The parties will try to resolve any disputes that arise through negotiations. If it is impossible to reach an agreement, the dispute will be referred to a judicial authority in accordance with the current legislation of Ukraine.
